Terms of Service
These terms are the agreement between you and Reallexi LLC (https://reallexi.io), the operator of Apex City, for playing on the web, Android or iOS. By ticking the box on the sign-up form, by starting a guest city, or by continuing to play, you accept them; we record the date and the version you accepted, and you can download that record at any time from Settings → Privacy → Export. Please also read the Privacy Policy, the Licence and the Refund Policy, which form part of this agreement.
1. Eligibility and age
You must be at least 13 to create an account with an email address or to use chat. Players under 13 may play as a guest in limited mode only (see Children). Purchases require you to be 16 or older, or to have the permission of a parent or guardian who accepts these terms on your behalf. We may ask for your age band and restrict features accordingly.
2. Your account
Keep your password and device secure; you are responsible for what happens under your account. Guest accounts live on one device until you link an email, Google, Apple or Facebook identity - we cannot recover a guest account from a lost device. One person, one account. Buying, selling, renting or sharing accounts is not allowed.
3. Licence to play
We grant you a personal, non-exclusive, non-transferable, revocable licence to play Apex City for your own entertainment, on the terms of the End-User Licence Agreement. The game, its art, code, names and content remain the property of Reallexi LLC and its licensors.
4. Virtual items and currencies
- Coins, gems, event tokens, buildings, cosmetics and passes ("virtual items") have no cash value and cannot be exchanged for money.
- Virtual items are a limited licence to use a feature of the game, not property, and are non-transferable between accounts.
- We may adjust, rebalance or remove virtual items to fix errors, prevent fraud or improve the game. Balances obtained through a bug or fraud may be removed.
- Virtual items expire when the account is deleted or terminated.
5. Purchases
Prices, including applicable tax, are shown at checkout in your store's currency. Delivery is immediate: items appear in your account as soon as the store confirms payment. For digital content delivered immediately you agree that the statutory right of withdrawal ends once delivery starts; our Refund Policy explains when we still refund. Android purchases go through Google Play, iOS through the App Store, and web through Stripe; those providers' terms also apply.
6. Subscriptions
Subscriptions renew automatically at the end of each term until cancelled. Cancel at any time in the Stripe customer portal (web), Google Play (Android) or App Store (iOS); you keep the benefits until the end of the paid term. If a renewal payment fails we allow a short grace period before benefits pause. Price changes are announced at least 30 days in advance and never apply to a term already paid.
7. Fair play and sanctions
Cheating, bots, modified clients, exploiting bugs, tampering with network traffic, and refund abuse are prohibited. Depending on severity we may warn you, remove gains, suspend chat or purchasing, or terminate the account. Purchases are not refunded on an account terminated for cheating. We never ban anyone for making a legitimate refund request.
8. Your content and conduct
City names, display names, avatars and chat messages are visible to other players. Do not post anything illegal, hateful, harassing, sexual, or that reveals personal information about anyone. You grant us a worldwide, royalty-free licence to display your city, avatar and display name inside the game and on leaderboards. We filter chat automatically, act on reports, and keep messages for 90 days.
9. Changes, availability and termination
We update the game regularly and may change or retire features, events and items. We try hard to keep the game online but cannot promise uninterrupted availability. You may stop playing and delete your account at any time. We may suspend or terminate accounts that break these terms, and may close the game with at least 90 days' notice, during which no new purchases will be sold.
10. Disclaimers and liability
Apex City is provided "as is". To the fullest extent the law allows, we exclude all warranties and are not liable for indirect or consequential losses, lost virtual items, or lost data. Our total liability for anything arising from the game is limited to the amount you paid us in the 12 months before the claim. Nothing here limits rights that consumer law gives you and that cannot be waived, nor our liability for fraud, death or personal injury caused by negligence.
11. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules and without affecting mandatory consumer protections in your country of residence. Consumers may bring proceedings in their own country's courts. EU consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged, and are not willing, to take part in dispute resolution before a consumer arbitration board.
12. Apple and Google
Where you obtained the app from Apple or Google, those companies are not parties to this agreement, have no obligation to support the app, and the additional terms in the Licence apply.
